By accessing or using Blocmount's software service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, visitors, and others who access or use the Service.
The Service is currently provided as a beta version ("Beta") for testing and evaluation purposes only. The Beta may contain bugs, errors, and other issues. You acknowledge and agree that:
(a) The Beta may not perform as expected and may be subject to interruptions, outages, and data loss;
(b) Blocmount reserves the right to modify, suspend, or discontinue the Beta at any time without notice;
(c) Features and functionality in the Beta may be altered or removed before any commercial release;
(d) Blocmount may collect feedback and usage data from your use of the Beta to improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Blocmount EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
Blocmount does not warrant that (a) the Service will be uninterrupted, error-free, or secure; (b) any defects will be corrected; or (c) the Service is free of viruses or other harmful components.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Blocmount, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL Blocmount'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO Blocmount IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100.00).
This limitation applies whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory, and even if Blocmount has been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless Blocmount and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
By using the Beta, you acknowledge that Blocmount may collect, store, and use data generated through your use of the Service, including usage patterns and feedback, to improve the Service. You are responsible for maintaining appropriate backups of your data. Blocmount is not liable for any loss of data occurring in connection with the Beta.
You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) infringe on the rights of any third party; (c) transmit any harmful, offensive, or disruptive content; (d) attempt to gain unauthorized access to the Service or its related systems; or (e) interfere with or disrupt the integrity or performance of the Service.
The Service and its original content, features, and functionality are and will remain the exclusive property of Blocmount and its licensors. Nothing in these Terms grants you any right, title, or interest in the Service, its underlying technology, or any intellectual property owned by Blocmount.
Blocmount reserves the right to terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
Blocmount reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Delaware, USA, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the courts located in Delaware, USA.
